You don’t tug on Superman’s cape, you don’t spit into the wind, you don’t pull the mask of the Lone Ranger, and you don’t mess with Apple’s legal dept. I don’t see this being about freedom of the press, but about money. The guy has a website that advertises, and he’s trying to drive traffic to it. He posts information that was obtained by someone who was violating a legal agreement that they signed, and he doesn’t think that he should have to reveal who it was? The fact that the EFF is not jumping in and offering to help (other than assisting in the search for attorneys willing to represent him) is intriguing. I wonder what Lessig’s take on this is going to be.
I’ve signed NDA’s before, and honor them. While I don’t always agree with Apple being so secretive about development of new and updated products, it’s their call. I’m hoping they offer this guy a Mac Mini, iPod Shuffle, drop the lawsuit, and he turns in the NDA violator.
If someone came to me with proprietary information with an offer for me to publish it, provided that I promised not to reveal their identity, I’d tell them to take a hike. Or I might just turn them in.
